Requirements to Become a Process Server in New Jersey

Process servers in the state of New Jersey are not required to be licensed.

 

Summonses shall be served together with a copy of the complaint, by the sheriff, or by a person specially appointed by the court, or by plaintiff’s attorney or the attorney’s agent, or by any other competent adult not having a direct interest in the litigation.

For instance, it is important to know that New Jersey law prohibits a process server from leaving service documents in someone's mailbox or affixing them to the door - also known as "nail and mail" service which is permitted in other jurisdiction such as New York. In New Jersey, the documents must be physically handed to the individual named in the documents, or a suitable age person who has confirmed that they live at the same address who is over the age of fourteen.
